Terms of Service

1. Acceptance of Terms
By accessing or using Daylore ("the Service," "we," "us," or "our") at https://daylore.app, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service. These Terms constitute a legally binding agreement between you and Daylore. We reserve the right to update these Terms at any time, and your continued use of the Service after any such changes constitutes your acceptance of the revised Terms.
2. Description of Service
Daylore is an AI-powered personal journaling platform that enables users to record daily entries, track moods and habits, receive AI-generated insights and coaching, and export or share their content. The Service is offered under a freemium model with Free, Pro, and Premium subscription tiers, each providing different levels of access to features and usage limits.
3. Eligibility
You must be at least 13 years of age to use the Service. If you are under 18, you represent that you have obtained parental or guardian consent to use the Service. By creating an account, you represent and warrant that all information you provide is accurate, current, and complete, and that you have the legal capacity to enter into these Terms.
4. Account Registration and Security
You may register for an account using an email address and password, or by authenticating through a supported third-party provider such as Google. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to notify us immediately at [email protected] if you suspect any unauthorised access to your account. Daylore will not be liable for any loss or damage arising from your failure to protect your account credentials.
5. Subscriptions and Payments
Daylore offers paid subscription plans (Pro and Premium) billed on a monthly or annual basis. All payments are processed securely through Stripe. By subscribing, you authorise Daylore to charge your payment method on a recurring basis at the applicable subscription rate until you cancel. Subscription fees are non-refundable except where required by applicable law. You may cancel your subscription at any time through the Billing section of your account settings; cancellation takes effect at the end of the current billing period. Daylore reserves the right to change subscription pricing with at least 30 days' notice to active subscribers.
6. User Content
You retain full ownership of all journal entries, notes, and other content you create within the Service ("User Content"). By using the Service, you grant Daylore a limited, non-exclusive, royalty-free licence to store, process, and transmit your User Content solely for the purpose of providing and improving the Service. Daylore does not sell, rent, or share your User Content with third parties for advertising or marketing purposes. You are solely responsible for the accuracy, legality, and appropriateness of your User Content.
7. AI-Generated Content
The Service uses artificial intelligence to generate summaries, insights, coaching responses, and other content based on your journal entries. AI-generated content is provided for informational and motivational purposes only and does not constitute professional medical, psychological, legal, or financial advice. You should not rely on AI-generated content as a substitute for professional guidance. Daylore makes no warranties regarding the accuracy, completeness, or fitness for purpose of any AI-generated content.
8. Prohibited Conduct
You agree not to use the Service to:
- Upload, transmit, or store content that is unlawful, harmful, threatening, abusive, defamatory, obscene, or otherwise objectionable.
- Impersonate any person or entity or misrepresent your affiliation with any person or entity.
- Attempt to gain unauthorised access to any part of the Service or its related systems.
- Reverse-engineer, decompile, or disassemble any portion of the Service.
- Use automated tools, bots, or scrapers to access or extract data from the Service without prior written consent.
- Violate any applicable local, national, or international law or regulation.
9. Intellectual Property
All rights, title, and interest in and to the Service — including its software, design, trademarks, logos, and documentation — are and remain the exclusive property of Daylore and its licensors. Nothing in these Terms grants you any right to use the Daylore name, logo, or other brand elements without our prior written consent.
10. Privacy
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the collection and use of your information as described in the Privacy Policy.
11. Termination
You may delete your account at any time through the account settings. Upon deletion, your User Content will be permanently removed from our systems within 30 days, subject to any legal retention obligations. Daylore reserves the right to suspend or terminate your account at any time, with or without notice, if we reasonably believe you have violated these Terms or if continued provision of the Service to you poses a risk to other users or to the platform.
12. Disclaimers
The Service is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. Daylore does not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components.
13. Limitation of Liability
To the fullest extent permitted by applicable law, Daylore and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of data, loss of profits, or loss of goodwill — arising out of or in connection with your use of the Service, even if Daylore has been advised of the possibility of such damages. In no event shall Daylore's total liability to you exceed the greater of (a) the amount you paid to Daylore in the 12 months preceding the claim, or (b) USD $50.
14. Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the jurisdiction in which Daylore is registered, without regard to its conflict of law provisions. Any dispute arising under these Terms shall first be subject to good-faith negotiation. If unresolved within 30 days, disputes shall be submitted to binding arbitration under the rules of a mutually agreed arbitration body, except that either party may seek injunctive or other equitable relief in a court of competent jurisdiction.
